Mammoth Dumps Service Agreement

TERMS OF LEASE

Mammoth Dump will provide dumpster disposal service using our dumpster containers. You must call 4 hours in advance to schedule a same-day swap out or pick up.

Additional Charges: All customers are responsible for the total weight of the contents of their dumpster(s). All customers are responsible for scheduling the removal of their dumpster(s). All customers are responsible for ensuring their dumpster(s) are not overloaded. Customers shall not exceed the "Maximum loading level". Customers shall not load hazardous waste or paint into dumpsters. Customers shall not load concrete, dirt, or sod into the dumpsters. Customers shall inspect the dumpster upon delivery for any existing damage. Upon removal of the dumpster, Mammoth Dump shall be entitled to charge the customer for the repair or replacement costs attributable to any damage to the dumpster while in the customer’s possession. The customer shall be liable for any repair or replacement costs. Upon removal, the customer authorizes Mammoth Dump to collect any additional disposal and repair or replacement costs attributable to the customer.

Using Heavy Equipment to Load: When loading the dumpster using heavy machinery such as excavators, skid steers, forklifts, or other heavy equipment, the customer assumes full responsibility for any damage to the dumpster. In the event of damage caused by heavy machinery, the customer will be billed for repair costs at a 3rd party rate plus a reasonable markup. This ensures that the integrity and functionality of our dumpsters are maintained, and any necessary repairs are addressed promptly and efficiently.

Exceeding the included weight allowance will result in an additional charge of $100 per ton or $0.05 per pound.

• 11 yard dumpster - 4000 lbs included ($100 per additional 2000 pounds) - In no event will the customer load debris weighing 10,000 lbs or more 
• 15 yard dumpster - 4000 lbs included ($100 per additional 2000 pounds) - In no event will the customer load debris weighing 12,000 lbs or more 
• 20 yard dumpster - 4000 lbs included ($100 per additional 2000 pounds) - In no event will the customer load debris weighing 14,000 lbs or more 

Any weight above the max tonnage allowed will result in refusal of service and off-loading shall be required. A dry run charge will be $197 per occurrence. Blocking or impeding retrieval of a dumpster on the agreed collection date will result in a dry run charge. Cleaning due to loading of restricted or hazardous materials may be billed at a 3rd party rate plus a reasonable markup.

For residents in Mariposa County: due to landfill fees being triple the cost of Merced landfill fees additional tonnage after 1 ton (2,000 lbs) will result in an additional fee of $150 per ton.

For commercial clients: Customers shall be liable for cost of "special disposal" items. The landfill determines "special disposal" items as sensitive records, large quantities of food, medical waste, and non-friable asbestos. "Special disposal" dumps cost $128.85/ton and the customer shall be responsible for this additional fee.

WASTE MATERIAL

Non-Hazardous Solid Waste Only: Customer agrees not to put any waste that is liquid, or any waste that is, or contains, radioactive, volatile, corrosive, highly flammable, explosive, biomedical, biohazardous, infectious, toxic, and/or any hazardous wastes or substances (“Prohibited Waste”) into dumpster containers. Prohibited Waste includes, but is not limited to, paint, batteries, paint cans, ashes, oil, sewage sludge, etc.

Inspection/Rejection of Prohibited Waste Title to and liability for Prohibited Waste shall remain with Customer at all times. Mammoth Dump shall have the right to inspect, analyze, and/or test any waste delivered by customer. 

Acknowledgement Customer: acknowledges that Mammoth Dump shall not be liable for any damage to driving surfaces resulting from Mammoth Dump trucks serving containers on the agreed upon areas and the surroundings. Customer acknowledges that they are not allowed to move around any dumpsters with their personal equipment or a third party’s equipment.

Payment Terms: Prepayment at the time of reservation is required by debit card or credit card, Mammoth Dump will keep that card on file until the account is at a zero balance. We require full payment upon completion of job. After 5 days of non payment a "Late Fee" consisting of 20% of the invoice total will be added to the final invoice. After 30 days of non payment your account will be passed along to our collection team.

ELECTRONIC SIGNATURE AGREEMENT

By digitally signing in the space provided below, I affirmatively consent and agree that:

1. Electronic Signature Acknowledgment: My electronic signature is legally binding, just as if I had signed a paper document by hand. I understand that my electronic signature is the legal equivalent of my manual signature on this Agreement.
2. Consent to Electronic Transactions: I consent to electronically complete and submit this service agreement. I acknowledge that my electronic submission constitutes my agreement and intent to be bound by the terms and conditions of the service agreement as outlined by Mammoth Dump.
3. Accuracy and Integrity of Information: I certify that the information provided by me in connection with this electronic signature is true, accurate, and complete.
